Terms of Service

1. About the Service

3Burchak is an education platform that connects students, parents and teachers. The Service includes tests and exams, homework, lesson plans, progress monitoring, learning games and the Ziya AI assistant. Some features are available only with a paid subscription.

2. Age and parental consent

• The Service is intended for school students, their parents and teachers.
• A minor uses the Service with the consent and under the supervision of a parent or legal guardian. A parent who creates an account for a child, or links to one, accepts these Terms on the child’s behalf and is responsible for the child’s activity in the Service.
• Only an adult or a parent may purchase a paid subscription.

3. Account and security

• An account is created with a phone number (via SMS code) or through Telegram. You agree to provide accurate and up-to-date information.
• The account is personal. Do not share your password, verification codes or sign-in links with anyone. You are responsible for all activity carried out through your account.
• If you notice unauthorised access to your account, notify us immediately at support@3burchak.uz.
• One device may hold profiles of several family members; each profile belongs to its owner and must not be used by another person.

4. User roles

• Student: completes tests independently, submits homework and uses Ziya AI to learn.
• Parent: connects to a child’s account only through a confirmed link, follows results and communicates with the teacher. A parent may link only to their own child or a child under their legal guardianship.
• Teacher: creates classes, assigns work, grades results and uses student data solely for educational purposes. The teacher agrees not to take student data outside the Service or share it with third parties.

5. Rules of use

When using the Service you must not:

• Create an account in another person’s name or impersonate another person, teacher or parent.
• Post or send content that is abusive, threatening, degrading, pornographic or harmful to children.
• Collect or distribute other users’ personal data, especially children’s, without their consent.
• Use cheating tools in exams or tests, falsify results, or use bots or automated scripts.
• Attempt to breach the security of the Service, exploit vulnerabilities, reverse-engineer or copy the software.
• Use the Service for unlawful, fraudulent or commercial spam purposes.

If the rules are broken we reserve the right to remove content, temporarily restrict the account or close it entirely.

6. Content and intellectual property

• Content you upload (homework photos, texts, messages, materials) remains yours. You grant us a limited licence to store, process, display and analyse it (including through Ziya AI) within the Service.
• You confirm that you hold the rights to the content you upload and that it does not infringe third-party rights.
• The design, code, question bank, mascot and texts of the Service belong to 3Burchak or its licensors. Copying, distributing or commercially using them without written permission is prohibited.
• Materials created by a teacher belong to the teacher and are shown only to the classes the teacher selects.

7. AI assistant

• Ziya AI and automatically generated tests are produced with artificial intelligence and may contain errors or inaccuracies. Answers are provided as a learning aid and do not replace a teacher, a textbook or an official exam result.
• Do not rely on AI answers for important decisions (grades, exam admission, medical or legal matters).
• AI conversations are limited to learning topics. Please report an incorrect or inappropriate answer using the “Report” button or by emailing support@3burchak.uz.

8. Subscriptions and payments

• Paid plans (for example START, PLUS, MAX) and their prices in Uzbek soums are shown in the app or on the website before payment. Prices may change; a change does not affect a period already paid for.
• On the website, payments are processed through Payme. In the iOS and Android apps, subscriptions are purchased through the Apple App Store or Google Play and are subject to their rules.
• A subscription purchased through a store renews automatically unless you cancel it at least 24 hours before the end of the current period. You can manage and cancel the subscription in your App Store or Google Play account settings.
• Refunds are handled in accordance with the rules of the stores (Apple, Google), Payme and the legislation of the Republic of Uzbekistan. For questions, contact support@3burchak.uz.
• A subscription applies to one account and the profiles connected to it through a confirmed family link. Transferring or selling a subscription to others is prohibited.
• In-app coins, achievements and virtual items have no monetary value, cannot be exchanged for real money and are lost when the account is closed.

9. Availability and changes

We aim to keep the Service running continuously, but temporary interruptions may occur because of maintenance, updates or causes beyond our control. We reserve the right to add, change or remove features; we will give advance notice of changes to paid features.

10. Termination

• You may delete your account at any time through “Delete account” in the app profile, or ask us to delete it by writing to support@3burchak.uz. Data is deleted within the periods stated in the Privacy Policy.
• In the event of a serious or repeated breach of these Terms, or where the law requires it, we may restrict or close an account without notice.
• When an account is closed, payment for an active subscription is not refunded unless the law or store rules provide otherwise.

11. Limitation of liability

The Service is provided “as is”. To the extent permitted by law, we are not liable for indirect losses, lost profit or loss of data arising from the use of, or inability to use, the Service. In any case our total liability does not exceed the amount you paid for the Service in the last 12 months. These limitations do not affect consumer rights guaranteed by law.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Uzbekistan. We seek to resolve disputes through negotiation first; if no agreement is reached, the dispute is heard by the competent court of the Republic of Uzbekistan.

13. Changes to the Terms

We may update these Terms. We will announce material changes through the app or the website. Continued use of the Service after the changes are published means you accept the new version.
